- Restrictions: You strictly agree not to copy, redistribute, resell, sub-license, decompile, modify, or reverse-engineer our software code.
7. Investment, Trading, and Financial Disclaimer
- No Financial Advice: The Service is strictly a technical software tool designed to help traders define and simulate strategies. We do not provide investment, financial, tax, trading, or legal advice.
- Assumption of Trading Risk: Financial market trading involves substantial risk of loss. All trading strategies simulated, tested, or executed via the software are done entirely at your own discretion and risk. Past performance simulated through this software is not a guarantee of future live market results.
- Broker API Connection: You connect your own independent broker API keys at your own risk. We assume no responsibility or liability for execution errors, latency, system downtime, order placement mismatches, or real-money financial losses incurred through your broker.
8. User-Connected Data Sources and Backtesting Input
- Data Accuracy Responsibility: The Service allows you to connect external third-party data feeds (via API webhooks) or upload custom datasets (such as CSV or JSON files) for historical backtesting. We do not verify, audit, or guarantee the accuracy, timeliness, or completeness of any data source you provide.
- Data Licensing Compliance: You represent and warrant that you possess all necessary rights, licenses, and legal permissions to use and input your chosen third-party data feeds into our software. You agree to indemnify us against any copyright, licensing, or regulatory claims arising from data feeds you connect.
9. Infrastructure Agnosticism and Hosting Environments
- Architectural Portability: Our software is designed to be infrastructure agnostic. You may freely deploy it on your own independent cloud environment (including, but not limited to, AWS, Microsoft Azure, Google Cloud Platform) or our recommended sister hosting company.
- Third-Party Infrastructure Fees: You enter into hosting agreements entirely at your own expense. We are not liable for any infrastructure costs, server resource spikes, or cloud billing overages generated by running automated scripts or resource-intensive backtests.
- Server Security and Maintenance: You are solely responsible for the technical configuration, firewall security, server updates, and data backups of your chosen hosting environment. We are completely exempt from liability for server crashes, data loss, database corruption, or malicious hacks occurring on your hosting infrastructure.
- Sister Company Disclosure: We may recommend a preferred hosting provider. Please note that this provider is a separate sister company under common ownership with us. Your relationship with the hosting company is governed by a completely separate legal agreement, and Tradjective bears no liability for server-level infrastructure failures managed by that separate entity.
- Support Limitations: Our operational support is limited strictly to core software functionality. We do not provide system administration support to troubleshoot underlying server hardware failures, custom network topologies, or third-party cloud platform configuration errors.
10. Limitation of Liability
To the maximum extent permitted by English law, Tradjective and its directors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of capital, live trading profits, historical data, or server availability resulting from your use of, or inability to use, our software.
11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
